AN ORDINANCE VACATING ARNOLD DRIVE IN THE VILLAGE OF WOODLAWN AND DECLARING AN EMERGENCY

AN ORDINANCE VACATING ARNOLD DRIVE IN THE VILLAGE OF WOODLAWN AND DECLARING AN EMERGENCY

WHEREAS, Arnold Drive is a paper street located on either side of Mayview Forest Drive between Woodstock and Woodlawn Boulevard; and WHEREAS, A development plan for the Woodlawn Meadows subdivision envisions the construction of a new street; and

WHEREAS, the construction of the new street requires that Arnold Drive be vacated; and WHEREAS, the owners of all the parcels adjacent to Arnold Drive have signed and delivered a petition to Village Council requesting that the street be vacated, a copy of which is attached as Exhibit A; and WHEREAS, Village Council is satisfied that there is good cause for said vacation, that it will not be detrimental to the general interest, and ought to be made;

NOW THEREFORE, be is ordained by the Council of the Village of Woodlawn, Hamilton County, Ohio, majority of all concurring:

SECTION I That Arnold Drive, as depicted on a plat entitled Right of Way Vacation Plat, a copy of which is attached hereto as Exhibit B, and more particularly described in the legal description attached as Exhibit C is hereby vacated.

SECTION II That the Village Law Director shall cause an authenticated copy of this ordinance and plat of vacation to be duly recorded on the land records of Hamilton County, Ohio.

SECTION III This ordinance is an emergency measure necessary for the preservation of public peace, health, safety and general welfare for the citizens of the Village of Woodlawn, Ohio, and shall go into effect immediately. The reason for the necessity of an emergency is the immediate need to vacate the street so that a new street dedication plat can be submitted within the necessary timeframes needed to allow for street construction of the new road.
